According to a private television channel, the petitioner, Shahid Orakzai, in his application, termed the Supreme Court's earlier decision unconstitutional whereby a three-member bench of the Supreme Court had formed a one-member commission on December 4 this year under a Federal Shariah Court judge.
He said that a court could "never form a commission in a criminal matter" and that the authority to form a commission was confined in civilian matters alone. "The Lal Masjid incident saw Ghazi Abdul Rasheed's followers clashing with the Army, hence it is a criminal matter," the petitioner asserted. Pointing out various Constitutional provisions, the petitioner stated that the Shariah Court judge was not obliged to follow the orders of the commission and "hence the investigation commission (should) be stopped from carrying out its work".
